Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter “Terms”) govern the relationship between Detay (hereinafter “the Seller” or “we”) and any person (hereinafter “the Customer” or “you”) making a purchase on the website www.detay.be (hereinafter “the Site”).
By placing an order on the Site, the Customer unconditionally accepts these Terms. If the Customer does not accept these Terms, they must refrain from placing an order.
1. Purpose
These Terms are intended to define the rights and obligations of both parties in connection with the sale of products and services offered on the Site by the Seller.
2. Products
The products offered for sale on the Site are those described on the product pages, subject to availability. The Seller strives to describe the products accurately but does not guarantee that descriptions, photographs, or other product-related information are free from errors.
3. Orders
The Customer may place an order on the Site by following the steps provided. Once the order is confirmed, the Seller will send a confirmation email to the Customer.
The Seller reserves the right to refuse an order in the event of an ongoing dispute with the Customer, non-payment, or any other technical or commercial issue that justifies refusal.
4. Prices
Product prices are displayed in euros and include VAT unless stated otherwise. Shipping costs are calculated separately and indicated before the order is confirmed.
The Seller reserves the right to change product prices at any time, but these changes will not affect confirmed orders.
5. Payment
Payment for products is made through the methods offered on the Site (credit cards, PayPal, etc.). The Customer guarantees that they have the necessary authorizations to use the chosen payment method.
Payment is due in full at the time of order. If paying by credit card, the Customer authorizes the Seller to debit their account for the total order amount.
6. Delivery
Products will be shipped to the delivery address provided by the Customer during the ordering process. The Seller undertakes to deliver the products within a reasonable timeframe, subject to availability. Delivery times are indicative and may vary depending on the destination.
In the event of a delay, the Customer will be informed by email. Delivery charges are the Customer’s responsibility unless otherwise specified.
7. Right of Withdrawal
In accordance with applicable legislation, the Customer has a 14-day right of withdrawal from the date of product receipt, without needing to provide justification or pay penalties. This right may be exercised by contacting the Seller via email or using the contact form available on the Site.
Returned products must be in their original condition and packaging. Return costs are the Customer’s responsibility unless the delivered product does not match the order.
8. Warranties
All products sold on the Site are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with the provisions of the Consumer Code.
If a product is defective, the Customer may request a refund or exchange under the conditions provided by law.
9. Personal Data Protection
The Seller is committed to respecting the confidentiality of collected personal data. The Customer’s personal data is collected and processed in accordance with the privacy policy available on the Site.
10. Intellectual Property
All elements of the Site (texts, images, logos, etc.) are protected by intellectual property rights. Any reproduction or use without the Seller’s express authorization is prohibited.
11. Liability
The Seller cannot be held liable for indirect damages or loss of profits resulting from the use of products purchased on the Site. In any case, the Seller’s liability will not exceed the total amount of the order.
12. Force Majeure
The Seller shall not be held liable in the event of force majeure, as defined by law, that prevents or delays the performance of its obligations.
13. Changes to the Terms and Conditions
The Seller reserves the right to modify these Terms at any time. The changes will be published on the Site and will become effective upon posting.
14. Applicable Law and Jurisdiction
These Terms are governed by Belgian law. In the event of a dispute, the competent courts will be those of the Seller’s domicile, unless another jurisdiction is applicable according to the rules of competence.
